Terms of Service

These Terms of Service ("Terms") govern your use of the Prompt XXL Chrome extension and web application (collectively, the "Services") provided by Prompt XXL ("we", "us", or "our").

By using our Services, you agree to these Terms. If you do not agree, please do not use our Services.

1. Use of Services

You may use our Services for personal and commercial purposes, subject to these Terms. You agree not to:

• Use the Services for any illegal purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Services
• Reverse engineer, decompile, or disassemble the Services
• Use automated means to access the Services without permission
• Share your account credentials with others

2. Accounts

To access certain features, you may need to create an account using Google Sign-In. You are responsible for:

• Maintaining the security of your account
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

3. Free and Pro Plans

Free Plan: Provides basic features with local storage. Free forever, no credit card required.

Pro Plan: Provides additional features including cloud sync across devices, several profiles, the web app and premium themes. Access to the public prompt collection is included where we offer it. Available as a monthly or yearly subscription or as a one-time Lifetime purchase.

4. Payments, Subscriptions and Lifetime

• Pro subscriptions are billed monthly or annually, as selected
• Payments are processed securely through Stripe
• Subscriptions automatically renew unless cancelled
• You can cancel anytime through your account settings; cancellation stops future renewals
• Except where a refund is required by applicable law, payments are non-refundable
• If you are a consumer in the EU/EEA: by starting Pro (subscription or Lifetime) you expressly request immediate access to digital content and services, and you acknowledge that you thereby lose your statutory 14-day right of withdrawal once access has been provided, to the extent permitted by law

Pro Lifetime:

• Pro Lifetime is a one-time payment. It does not renew and is not billed again
• "Lifetime" means for as long as we offer XXL Prompt Manager Pro, not the lifetime of the buyer. If we discontinue Pro, we will tell you at least 12 months in advance, and you can export your prompts at any time
• Pro Lifetime includes the same Pro features as a subscription
• Pro Lifetime covers the Pro plan only. Other plans or products we may offer later, for example team or business plans, are not included
• Pro Lifetime belongs to the account used for the purchase and cannot be transferred
• The payment rules above apply to Pro Lifetime as well: except where a refund is required by applicable law, the payment is non-refundable, and the EU/EEA consent to immediate access applies
• A refund or a chargeback ends Pro Lifetime access

5. Your Content

You retain ownership of all prompts and content you create using our Services. By using our Services, you grant us a limited license to store and process your content solely to provide the Services.

You are responsible for ensuring your content does not:

• Violate any laws or regulations
• Infringe on intellectual property rights
• Contain harmful or malicious content

6. Public Prompts

Pro users may access our library of public prompts. These prompts are provided for personal use. You may not redistribute or resell public prompts.

Publishing prompts: Pro users may publish their own prompts to the public library. By publishing a prompt, you grant us a worldwide, non-exclusive, royalty-free license to display it to other users and allow them to copy it into their own libraries. You must have the necessary rights to any prompt you publish, and published prompts must not contain personal data, unlawful content, or content that infringes third-party rights. We may remove published prompts at our discretion, including for policy violations. You can request removal of your published prompts at any time.

7. Intellectual Property

The Services, including all software, designs, and content (excluding user content), are owned by Prompt XXL and protected by intellectual property laws. You may not copy, modify, or distribute our intellectual property without permission.

8. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROMPT XXL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES.

10. Indemnification

You agree to indemnify and hold harmless Prompt XXL from any claims, damages, or expenses arising from your use of the Services or violation of these Terms.

11. Termination

We may suspend or terminate your access to the Services at any time for violation of these Terms. You may stop using the Services at any time.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes. Continued use of the Services after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms are governed by the laws of Bulgaria. Any disputes shall be resolved in the courts of Bulgaria. If you are a consumer, mandatory consumer-protection provisions of the country in which you reside remain unaffected.
